1.1 Refreshi's mission is to bring new life to surplus food and help provide more affordable meals in South Africa. Our mobile application ("Refreshi App") helps businesses and consumers by saving food that would otherwise go to waste.

1.2 We provide a platform empowering consumers ("users") to save surplus food from retail and food service businesses ("Stores"). Stores offer surplus food as "Surprise Bags" — bags filled with surplus food available for purchase through the App.

1.3 Refreshi does not own, control, offer, or manage the contents of any Surprise Bag. Refreshi is not a party to the sale of food that Stores provide to you.

These Terms constitute a binding legal agreement between you and Refreshi governing your use of the Refreshi App and website (collectively, the "Refreshi Marketplace"). By accessing or using any part of the Refreshi Marketplace, you accept these Terms without limitation.

3.1 How to save a meal: (1) A Store lists a Surprise Bag. (2) Available Stores appear in your app based on location. (3) You place an order. (4) You collect your bag at the Store during the specified collection window.

3.2 User Account: You must register and create an account providing accurate, complete information. Never share your account, impersonate others, or use offensive usernames.

3.3 Orders: By placing an Order, you reserve a Surprise Bag. An Order is an offer to purchase — the actual sale is concluded upon Collection. Orders may not be available if the Store has insufficient surplus.

3.4 Order Confirmation: Once received, we will send you an Order Confirmation with a unique order number, redeemable at the applicable Store.

3.5 Collection: You must collect your Surprise Bag at the designated location during the collection window stated in the App. Show your Order Confirmation and swipe the receipt upon collection. Failure to collect may result in forfeiture of payment.

3.6 Cancellation: You may cancel via the App within 2 hours before the collection window begins. Stores may cancel until 30 minutes before collection (or later in exceptional circumstances). Refreshi may cancel at its sole discretion when necessary.

4.1 Refreshi has no insights into Surprise Bag contents and is not responsible for contents, quality, ingredients, or allergens. We are exclusively an intermediary.

4.2 Stores are responsible for providing allergen information and ensuring Surprise Bag contents are safe at the time of collection. Always confirm allergen information with the Store before accepting your bag.

5.1 All prices are displayed in Rand (ZAR). The stated value is a minimum retail value of the bag's contents.

5.2 Refreshi collects payment from you on behalf of the Store via the App using Peach Payments.

5.3 You may pay with accepted debit and credit cards or other payment methods available in the App. Refreshi does not store your card details.

5.4 Refunds are processed automatically for Store-cancelled orders (1–3 business days). All refund requests must be submitted within 24 hours of the end of the collection window.

Submit complaints through the Help Centre in the App's Profile section within 48 hours, including your reason for dissatisfaction and any supporting information.

You are responsible for all activity on your account. You must comply with all applicable laws and behave respectfully toward Stores, their staff, other consumers, and Refreshi personnel. Refreshi may suspend or terminate accounts for violations of these Terms.

You agree to indemnify Refreshi against claims arising from your use of the Marketplace, breach of these Terms, or violation of applicable law. Refreshi is not liable for acts of Stores or third parties, unavailability of the Marketplace, or circumstances outside Refreshi's control. To the maximum extent permitted by law, Refreshi's liability is limited to amounts collected from you in the 12 months preceding the claim.

The Refreshi Marketplace, including all software, graphics, trademarks, and designs, is the sole property of Refreshi. No licence is granted except as expressly set out in these Terms.

Refreshi reserves the right to suspend or terminate your access at any time for material breach of these Terms, legal requirements, or conduct causing harm to Refreshi, Stores, or third parties.

12.1 The Refreshi Marketplace is provided "as is" and "as available." We disclaim all warranties except as required by law.

12.2 We may update these Terms at any time with notice via the Platform. Continued use constitutes acceptance.

12.3 These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in South African courts.
